Terms of Service
The agreement between you and emit when you use emit.run. Please read it: by creating an account or using the service, you agree to it.
Last updated September 29, 2026
1. Who we are
emit (emit.run, “we”, “us”) is a service operated by Pixel Dev LLC, Portland, Oregon, USA; you can reach us at support@emit.run. “You” means the person who accepts these terms and, if you use emit for a company or other organisation, that organisation. If you accept for an organisation, you confirm that you are allowed to bind it.
You must be at least 18 years old, or the age of majority where you live, to use emit.
2. The service
emit is a managed job queue and durable workflow service for developers. You create clusters, send jobs and workflow runs to them through our API, SDKs and command-line tool, and follow them in the dashboard. Your own workers run your code on your own systems; emit stores and hands out the jobs. We offer these plans:
- Free: 1,000 jobs a month, no payment method needed.
- Serverless: a monthly fee for each cluster, plus a price per million jobs.
- Dedicated: nodes that run only your cluster, billed by the node.
Current prices and limits are on our pricing page and in the dashboard. We may add, change or remove features over time, and we may change the Free plan’s limits or withdraw it. If we remove a feature you pay for, we will tell you ahead of time where we reasonably can.
3. Your account
You sign in with a code we email to you; there is no password. Anyone who can read your email can sign in as you, so keep your email account secure. An account is for one person: do not share it.
API tokens you create give access to your cluster. Keep them secret, and revoke any token you think has been exposed. You are responsible for activity under your account and your organisation, including by people you invite. If you believe your account has been compromised, tell us at support@emit.run.
We send notices about your account to the email address you sign in with, and notices about an organisation to its owners. Keep that address current.
4. Payment
- Paid plans are sold through Link, Stripe’s payment service, which is the merchant of record: it charges your payment method, handles any sales tax or VAT, and sends your receipts and invoices. You may be asked to accept its terms when you pay.
- We measure your usage (jobs on Serverless, node time on Dedicated, and storage and data transfer beyond what your plan includes) and bill it monthly, after the fact. Nodes are billed by the second.
- The Serverless fee is charged each month for each Serverless cluster. A cluster added partway through a billing period may be charged, prorated, for the rest of that period. Deleting one partway through does not give a credit for the rest of the period.
- A Free cluster that reaches 1,000 jobs in a calendar month (UTC) is paused until the next month starts, or until you upgrade it.
- If a payment fails, Link retries it. While it is unpaid for more than 3 days you cannot create or grow clusters. If your subscription ends, because you cancel it or because the payment could not be collected, your Serverless clusters are paused right away, and your Dedicated clusters and their data are deleted after 7 days unless a working payment method is added first. We email your organisation’s owners when this happens.
- We will give at least 30 days’ notice by email before a price increase applies to you. A price decrease may apply straight away.
- Fees are not refundable, except where the law or Link’s own policies require a refund. If you think a charge is wrong, tell us at support@emit.run.
5. Limits and fair use
Each plan has limits, such as how many jobs can be in flight at once and how often workers can claim jobs. Serverless clusters share capacity with other customers. To keep that fair, we may slow a Serverless cluster whose use is far outside normal patterns, for example by making new jobs wait, and we will try to contact you first when we can. If you need more capacity, contact us or move to Dedicated.
6. Acceptable use
You agree not to:
- use emit for anything illegal, or to store or send content that is illegal, that infringes someone else’s rights, or that you have no right to use;
- use emit to send spam, distribute malware, or run phishing or fraud;
- attack, probe or scan emit or other customers’ clusters, or try to get around security, access controls or plan limits;
- overload the service on purpose, or use it in a way that harms other customers, for example by creating accounts to get around Free limits;
- resell the service or give others access to it as if it were your own product, without our written agreement;
- copy, reverse engineer or build a competing service from the parts of emit.run that are not open source, except where the law allows it;
- use emit where a failure or delay of the service could lead to death, injury or serious damage, such as in life-support, safety or emergency systems;
- use emit in breach of export control or sanctions laws, or if you are in a country or on a list that those laws forbid us from serving.
If you believe content stored in emit infringes your rights or breaks the law, email support@emit.run with a description of the content, where it is, and how it affects you. We may remove content, or suspend access to it, when we are told it is unlawful.
7. Your data
“Customer data” means what you put into emit: the jobs and workflow runs you create, with their payloads, results, progress, logs and names. You own your customer data. You give us permission to store, copy, transmit and process it only as needed to run, secure and support the service for you, and as the law requires. We do not sell it, share it for advertising, or use it to train AI models. Our Privacy Policy says how we handle it and how long we keep it.
You are responsible for your customer data: that you have the right to use it, that sending it to emit is lawful, and that you keep your own copy of anything you cannot afford to lose. emit is not designed for regulated data such as health records or payment card numbers. Do not put such data in jobs unless you encrypt it yourself first.
8. Availability and your data’s safety
We do not currently offer a service level agreement or an uptime commitment. We work to keep emit running and to fix problems quickly, but the service may be interrupted, including for maintenance and upgrades. We do not promise that data cannot be lost. Keep your own copy of anything you cannot afford to lose.
9. Suspension and ending
You can stop using emit at any time: delete your clusters, and cancel billing from the Billing page. To delete your account, email support@emit.run from the address you sign in with.
We may suspend or close your account, or pause or delete clusters, if you break these terms, do not pay, put the service or other customers at risk, or if the law requires it. Where it is reasonable, we will warn you first and give you a chance to fix the problem. We may also end the service as a whole; if we do, we will give at least 30 days’ notice so you can move your data.
When your account is closed, by you or by us, your clusters are deleted and their data with them, as the Privacy Policy describes. Export anything you need first. Fees you already owe stay due, and sections 7 and 10 to 16 continue to apply.
10. Our property and your feedback
emit.run, its software, documentation and name belong to us or our licensors. The parts we publish as open source, such as our SDKs and command-line tool, are yours to use under their own licences. These terms give you no other rights to them. If you send us ideas or suggestions, we may use them without owing you anything.
11. Disclaimer
emit is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not control the code your workers run, or the networks between you and emit.
12. Limitation of liability
To the extent the law allows: neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data; and our total liability for all claims about emit is limited to the greater of what you paid for emit in the 12 months before the claim and US$100. These limits do not apply to liability that the law does not let us limit, such as for fraud, or for death or personal injury caused by negligence, and they do not limit what you owe us in fees. Some places do not allow these limits, so they may not all apply to you.
13. Indemnity
You will defend us against claims by third parties arising from your customer data or from your use of emit in breach of these terms, and pay any damages and reasonable costs that result. We will tell you promptly about such a claim and give you reasonable help with it.
14. Changes to these terms
We may update these terms. For a significant change, we will email your organisation’s owners at least 30 days before it takes effect, unless the change is required by law or is needed to address a security or legal risk, in which case we will give as much notice as we can. If you keep using emit after a change takes effect, you accept the new terms. If you do not accept them, stop using emit and delete your clusters.
15. Governing law
These terms are governed by the laws of the State of Oregon and applicable US federal law, and disputes about them will be heard by the state and federal courts located in Multnomah County, Oregon, except where the law where you live gives you the right to bring a claim there.
16. General
These terms and the Privacy Policy are the whole agreement between you and us about emit. If a part of them cannot be enforced, the rest still applies. If we do not enforce a part, we have not given up the right to. You may not transfer your rights under these terms without our consent; we may transfer ours as part of a merger, acquisition or sale of the business, and we will tell you if we do. Neither party is liable for delays or failures caused by events beyond its reasonable control, such as outages at our providers, natural disasters or government action. Nothing in these terms creates a partnership, agency or employment relationship between us.
